Course Description

This course deals with history of international law and sources of international law. The topics are as follows:

(1) the characteristics of international law; (2) history of international law upto the 17th Century; (3) history of international law from the 18th Century to the 19th Century; (4) history of international law since the 20th Century; (5) Article 38 of the Statute of the International Court of Justice [1]: formal sources; (6) Article 38 of the Statute of the International Court of Justice [2]: subsidiary means for the determination of rules of law and equity; (7) law of treaties [1]: concept and concluding process; (8) law of treaties [2]: entry into force and reservation; (9) law of treaties [3]: interpretation; (10) law of treaties [4]: invalidity and termination; (11) customary international law and multilateral conventions; (12) sources of international law other than Article 38 of the Statute of the International Court of Justice; (13) hierarchical order of international law; (14) the relationship between international law and domestic laws.
